Dependence in the ideological estimation of legal phenomena, reserved judicial authorities matters, is proved to result in the narrowing of the specific sociophilosophic content of the judicial authority and, as consequence, in the system problems connected with the judicial authority value as a social institution. Judicial authority realizing another’s interest is considered. This assumes sociophilosophic analysis of that will and that interest which specifies its power focus, and this implies that the judicial authority is reduced to the judicial duty.
Доказано, что несамостоятельность в идеологической оценке правовых явлений, которые отнесены к компетенции судебных органов, ведет к сужению собственного социально-философского содержания судебной власти и, как следствие, системным проблемам, связанным с ценностью судебной власти как социального института. Рассматривается судебная власть, реализующая чужой интерес, что предполагает социально-философский анализ той воли и того интереса, которые определяют ее направленность власти, а это означает, что судебная власть редуцируется в судебную функцию.
